Dining Services Supervisor - Rochester, NY
Pneumococcal Bacteremia
“A Dining Services Supervisor from New York developed a severe infectious disease that affected the neurological tissue in her spine and brain. After her long hospitalization, she was unable to return to work. She applied for Short Term and Long Term Disability benefits. She was paid Short Term Disability benefits for six months, but when the transition to Long Term Disability was set to begin, Prudential abruptly denied her claim. According to them, she was capable of performing light duty work.
After an online search led her to Fields Disability, she chose them to file her appeal. The Fields Disability team set out to gather all the supporting documentation to launch a successful appeal. The Fields Disability attorneys submitted a strong appeal utilizing the updated medical evidence and statements from our client’s treating providers documenting that she was unable to perform the duties of a dining services supervisor position. After a review, Prudential company reversed the original decision paying our client all past-due benefits, and ongoing benefits.”
Staffing Agent - Lockport, NY
Spinal Stenosis in the Lumbar Region, Cervical Disc Disorder, Radiculopathy, Lumbar Laminectomy
“A Staffing Agent from New York suffered from spinal stenosis in the lumbar region, cervical disc disorder with radiculopathy, and complications following lumbar laminectomy surgery. She worked with these conditions until they progressed and forced her to stop working. She applied for disability benefits, but The Hartford denied her application for Long Term Disability benefits claiming her records did not support the restrictions and limitation preventing a return to work in her job. Upset with the denial of Long Term Disability benefits, she called Fields Disability to help her appeal the denial decision.
Our disability team contacted our client’s doctors to compile reports of all of her conditions, symptoms, and treatment. We reviewed her Functional Capacity Evaluation (FCE) that determined she was unable to perform sedentary work. Our attorneys submitted an appeal stressing and comparing the FCE to the physical requirements outlined in the Staffing Agent/Manager Client Programmer job description highlighting that she was unable to perform the material duties of her own occupation. Fields Disability noted the lifting requirements, the prolonged standing, and the walking requirements of her occupation. On appeal, The Hartford reversed its denial of benefits, paid our client’s past due benefits, and began making monthly payments.”
Collection Team Lead - West Jefferson, OH
Status Post Laminectomy and Revision
“A Team Lead for a collections agency in Ohio developed widespread degenerative disc disease. He underwent a laminectomy at L3-5 to correct the issues. The surgery was unsuccessful, and he had to undergo a full revision surgery a year later. The first surgery rendered him unable to work, and he applied for disability benefits under his policy. Prudential approved the claim. After just two months, Prudential denied his benefits stating his medical information did not support restrictions or limitations preventing his return to his job.
He hired Fields Disability to appeal his case. The Fields Disability team requested updated medical records from all of our client’s treatment providers, and had him undergo a full Functional Capacity Evaluation in order to demonstrate that he was functionally incapable of returning to his regular occupation. The Fields Disability attorneys submitted the appeal with additional information and strong arguments. After several weeks of review, Prudential paid our client’s past due benefits and awarded ongoing benefits.”
Line Haul Trucker - Hockingport, OH
Heart Failure, Spinal Stenosis
“A line haul trucker based out of Ohio developed debilitating heart conditions that limited his ability to perform any sort of sustained activity. He applied for Long Term Disability benefits and he was paid benefits for a year, until Liberty Mutual denied his claim stating he was able to do a less demanding job. That was when he hired Fields Disability to appeal his wrongful denial of benefits.
The Fields Disability team began gathering additional information to support our client’s claim. Our attorneys gathered substantial evidence that our client was unable to perform even seated work on a full-time basis. The team recognized that our client had very limited skills, and hired a vocational consultant to review whether he would be a competitive applicant for employment. We submitted the vocational expert’s report, with the additional medical documentation. On review, Liberty Mutual reinstated our client’s benefits.”
Dispatcher - North Babylon, PA
Irritable Bowel Syndrome, Severe Anxiety
“A dispatcher from Pennsylvania suffered from severe irritable bowel syndrome and anxiety, which meant she was unable to continue working in her sedentary occupation. She applied for Long Term Disability benefits, but Cigna denied her claim, stating that her medical records did not support any condition that would prevent her from doing her job.
Confused, she reached out to Fields Disability. Our disability team went to work updating our client’s medical records and gathering supporting documentation to submit to Cigna. On appeal, the Fields Disability attorneys provided Cigna with a report from her treating doctor outligning her condition and inability to work. After reviewing the information, Cigna reversed the denial paying our client all past due benefits, and reinstated her monthly benefits.”
