Here are just a few of our lawsuit wins for our clients around the United States.
Line Haul Trucker - Hockingport, OH
Heart Failure, Spinal Stenosis
“A line haul trucker based out of Ohio developed debilitating heart conditions that limited his ability to perform any sort of sustained activity. He applied for Long Term Disability benefits and he was paid benefits for a year, until Liberty Mutual denied his claim stating he was able to do a less demanding job. That was when he hired Fields Disability to appeal his wrongful denial of benefits.
The Fields Disability team began gathering additional information to support our client’s claim. Our attorneys gathered substantial evidence that our client was unable to perform even seated work on a full-time basis. The team recognized that our client had very limited skills, and hired a vocational consultant to review whether he would be a competitive applicant for employment. We submitted the vocational expert’s report, with the additional medical documentation. On review, Liberty Mutual reinstated our client’s benefits.”
Dispatcher - North Babylon, PA
Irritable Bowel Syndrome, Severe Anxiety
“A dispatcher from Pennsylvania suffered from severe irritable bowel syndrome and anxiety, which meant she was unable to continue working in her sedentary occupation. She applied for Long Term Disability benefits, but Cigna denied her claim, stating that her medical records did not support any condition that would prevent her from doing her job.
Confused, she reached out to Fields Disability. Our disability team went to work updating our client’s medical records and gathering supporting documentation to submit to Cigna. On appeal, the Fields Disability attorneys provided Cigna with a report from her treating doctor outligning her condition and inability to work. After reviewing the information, Cigna reversed the denial paying our client all past due benefits, and reinstated her monthly benefits.”
Department Store Manager - Gettysburg, PA
Plantar Fasciitis
“A department store manager in Pennsylvania stopped working due to the progression of plantar fasciitis. Her occupation required her to be on her feet for eight to 10 hours per day, and her foot pain became so severe that she couldn’t stand or walk for more than a few minutes. She submitted a claim for disability benefits under her policy issued to her employer. She was paid benefits for several months, until Cigna denied her claim stating she could return to work because she could stand for up to six hours per day. She submitted her own appeal but was denied, so she hired Fields Disability to file a second appeal on her behalf.
The Fields Disability team began gathering additional information and documentation to support her claim. Our attorneys uncovered a crucial mistake in the vocational review performed on our client’s case by Cigna. They noted that Cigna failed to consider how much time she was actually required to be on her feet while working. The Fields Disability team hired a vocational expert to explain actual duties required by our client’s job. After a review on appeal, Cigna reversed the denial paying our client her past due benefits. Our client’s benefits were reinstated, providing her with a stable source of income.”
Material Handler - Greeneville, TN
Aortic Aneurysm, Chronic Neuropathy, Pain, Fatigue
“A materials handler from Tennessee worked for several years with a serious heart condition. His condition progressed, and he was unable to continue working. He suffered from chronic fatigue, neuropathy, and numbness. His claim was approved and he was paid benefits for two years. Cigna denied the claim after two years stating his records did not support total disability from sedentary work, at which point he reached out to Fields Disability.
Our disability team began gathering updated medical records, and additional information to support his claim for benefits. The Fields attorneys reviewed all of Cigna’s records, and the additional information that was gathered, then they drafted an appeal arguing that the denial was improper. On appeal, Cigna reversed their decision and reinstated the payment of monthly benefits.”
Machine Operator - Chattanooga, TN
COPD, Sarcoidosis, Hyertension
“A machine operator from Tennessee was suffering COPD, sarcoidosis, and hypertension. She was removed from work by her treating doctors, as it was no longer considered safe for her to continue working. She applied for Long Term Disability benefits through her employer’s policy, but was denied by Cigna. According to them, her medical records did not show that she was totally unable to work, so she turned to Fields Disability for help.
The Fields Disability team gathered and submitted additional information to support her claim, but Cigna did not reverse the denial. Undeterred, we gathered narrative reports from her treating providers, all of the medical evidence related to her claim, and her entire Social Security Disability file to establish she could no longer perform her job. Our attorneys submitted the second appeal with additional information and arguments. After the second appeal, the denial was reversed, paying our client all her past due benefits, and she was awarded ongoing monthly benefits.”
