After the waiting period expired, Guardian denied benefits, saying that the application was received two days after his disability had begun so he was not covered by the policy.

The first part was entirely procedural: Guardian was reading its own policy wrong with regards to coverage. “A County Recording Clerk in Minnesota ceased working at the recommendation of her doctors due to a progression of her rheumatoid arthritis, trigger finger, chronic fatigue, and osteoarthritis in her knees, hips, and low back. She applied for disability benefits, but Madison National denied her Short Term Disability benefits and her application for Long Term Disability benefits. Unsure where to turn next, she reached out to the Fields Disability to appeal her Short Term and Long Term claim decisions.

The Fields Disability team gathered additional medical records, and a narrative report from our client’s treating doctors. The Fields attorneys submitted an appeal, but Madison National reviewed and upheld its original decision because our client returned to work after surgery and physical therapy, and Madison National used the return to work to assert that she was never disabled from performing her own occupation.

With a second appeal available, our team obtained additional updated medical evidence and additional supportive narrative reports stating that our client’s ability to return to work was due to her physical therapy and time off work to recover from her surgery. After review, Madison National overturned its denial and approved all of her Short Term Disability benefits and two months of Long Term Disability benefits.”
